Probate, Trust and Guardianship Litigation

Brown Pruitt Peterson & Wambsganss, P.C.’s attorneys have extensive experience with litigation involving probate, trusts and guardianships. We represent both proponents and contestants in will contest cases and applicants and contestants in contested guardianships. We prosecute and defend claims against executors, administrators, trustees, guardians and agents under powers of attorney for all claims, including breach of fiduciary duty and removal. We are experienced in litigating questions of undue influence, coercion and capacity. We are also experienced in litigating issues involving the community or separate character, tracing and valuation of assets. We also represent clients in claims as beneficiaries of insurance policies, annuities and retirement plans. We are available to clients all over Texas.

The attorneys at Brown Pruitt Peterson & Wambsganss, P.C. understand that most of these cases involve litigation between family members and we realize the emotional toll taken on our clients and the destructive effect on family relationships. We work closely with our clients throughout the litigation process to ensure they are aware of the status of their cases and have the ability to direct the course of the litigation. Whether it is through settlement or trial, we strive to achieve the best possible outcome for our clients.
